Terms and Conditions of Business

Please read these Terms and Conditions carefully before booking our services. By making a booking with Polished Spaces, you agree to be bound by the terms set out below.
1. Definitions and Interpretation
In these Terms and Conditions, the following definitions apply:
"The Agency": Refers to Polished Spaces, acting as an introduction and management agency.
"The Client": Refers to the person, firm, or corporate body to whom the cleaning services are supplied.
"The Cleaner": Refers to the self-employed independent contractor introduced by the Agency to the Client.
"The Service": Refers to the introduction of a Cleaner to the Client and the ongoing administrative management of the booking.
2. The Agency Role
2.1. Polished Spaces acts as an introduction agency. Our primary function is to source, vet, and introduce self-employed Cleaners to Clients and to facilitate the ongoing scheduling and payment processing.
2.2. The Cleaner is a self-employed independent contractor and is not an employee of the Agency.
2.3. While the Agency undertakes robust vetting procedures (including ID, reference, and DBS checks where applicable), the Agency does not offer a guarantee of the Cleaner’s performance, as the Cleaner works under their own direction.
3. Fees and Payment
3.1. Rates: The hourly rate agreed upon at the time of booking includes the Cleaner’s pay and the Agency’s management fee.
3.2. Payment Method: All payments must be made directly to Polished Spaces via our designated payment method (e.g., Direct Debit / Card Payment).
3.3. No Cash Payments: The Client agrees not to pay the Cleaner directly in cash for the core service hours. Tips, however, may be given directly to the Cleaner at the Client's discretion.
3.4. Invoicing: Payments are processed [Weekly / Monthly] in advance or upon completion of the work, as agreed during booking.
3.5. Late Payments: The Agency reserves the right to suspend services immediately if payment is not received by the due date. Late payments may incur an administrative fee of £10.00 per overdue notice.
4. Cancellations and Lockouts
4.1. Client Cancellation: The Client must provide at least 24 hours’ notice to cancel or reschedule a cleaning visit.
4.2. Late Cancellation Fee: * Cancellations made with less than 24 hours’ notice will be charged at 100% of the total visit fee. This is to ensure the self-employed Cleaner does not suffer a loss of income.
4.3. Lockouts: If the Cleaner arrives at the property and cannot gain access (e.g., keys not left out, faulty lock, or Client not home), the full fee for the scheduled visit remains payable.
4.4. Termination of Regular Service: The Client may terminate a recurring cleaning agreement by providing [14 Days / 1 Month] written notice to the Agency.
5. Client Responsibilities
5.1. Equipment and Supplies: To prevent cross-contamination and ensure the correct care of your home, the Client shall provide all necessary cleaning materials and equipment (including, but not limited to, vacuum cleaner, mop, bucket, cloths, and cleaning fluids). 5.2. Safety of Equipment: The Client must ensure that all electrical equipment provided (e.g., vacuum cleaners) is in safe working order. The Cleaner generally cannot use industrial cleaning equipment or bleach.
5.3. Environment: The Client must provide a safe working environment, including access to hot water and electricity.
5.4. Instructions: The Client is responsible for providing clear instructions to the Cleaner regarding specific tasks or delicate surfaces.
6. Liability and Insurance
6.1. Agency Status: As the Agency acts solely as an intermediary, Polished Spaces shall not be liable for any acts, omissions, or negligence of the self-employed Cleaner, except where such liability cannot be excluded by law.
6.2. Insurance Cover: The Agency maintains a Public Liability Insurance policy. This policy covers accidental damage caused by the Cleaner, subject to the terms of the policy.
6.3. Excess: A standard insurance excess of £250.00 applies to any claim. The Client is responsible for the first £250.00 of any damage claim. Claims under £250.00 must be resolved directly between the Client and the Cleaner (though the Agency will facilitate this communication).
6.4. Bleach Clause: The Agency and Cleaner accept no liability for damage caused by the use of bleach or products containing bleach, if the Client has requested or provided these products.
6.5. Reporting Damage: Any damage must be reported to the Agency in writing within 24 hours of the cleaning visit. Failure to do so may invalidate a claim.
7. Non-Solicitation (Anti-Poaching)
7.1. The Client agrees that they will not privately engage, employ, or hire any Cleaner introduced by Polished Spaces, thereby bypassing the Agency fees.
7.2. This restriction applies for the duration of the agreement and for a period of 12 months after the termination of the service.
7.3. Referral Fee: If the Client wishes to hire the Cleaner directly, the Client agrees to pay Polished Spaces a one-off Recruitment & Referral Fee of £500.00.
8. Complaints and Refunds
8.1. In the unlikely event that the Client is dissatisfied with the standard of cleaning, the Client must notify the Agency within 24 hours. 8.2. The Agency will endeavour to rectify the issue, which may include offering a re-clean of the specific areas free of charge. Refunds are granted solely at the discretion of the Agency management.
9. Data Protection
9.1. The Agency processes Client data in accordance with the Data Protection Act 2018 and GDPR.
9.2. The Client’s name, address, and contact details will be shared with the assigned Cleaner strictly for the purpose of fulfilling the service contract.
10. Jurisdiction
10.1. These Terms and Conditions are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the Courts of England and Wales.
